    What U.S. import controls apply to tobacco, cigarettes, and cigars?

    Importers are required by the Federal Trade Commission to properly label packaging of tobacco products in accordance with the Cigarette Labeling and Advertisement Act. There are four Surgeon General's warning labels that must be placed on each packet. These labels must be rotated on cigarette packing in accordance with a plan filed and approved by the FTC, prior to importation into the U.S. Tobacco importations are also subject to IRS taxes. Commercial tobacco importers must have a permit issued by the Bureau of Alcohol, Tobacco and Firearms. Tobacco products may be subject to Animal and Plant Health Inspection Service inspections. More information may be found in Importing into the United States. Duty rates on tobacco products can be obtained in Chapter 24, 'Tobacco and Manufactured Tobacco Substitutes' in the HTS. An arriving, adult nonresident may import for personal use 50 cigars, or 200 cigarettes, or 2 kilograms of smoking tobacco, or a proportional amount of each, duty and tax exempt. An arriving nonresident, once every 6 months, may include not more than 100 cigars under the $100 exemption from duty and tax, provided the cigars accompany him and are to be disposed of only as bona fide gifts. Additional cigarettes and cigars, in excess of the foregoing exemption quantities and values, if admissible, may be admitted upon the payment of duties and taxes.
